How a public sale works

Every property sold at public auction, in one place: by private enforcement agents and by state sellers, including regional administrations, the Privatization Agency, the Bulgarian Development Bank, state hospitals and companies. Realistimo republishes the notice and links to the original; documents and bids go to the seller.

Questions and answers

Who sells these properties?

A private enforcement agent sells a debtor's property under the Bulgarian Civil Procedure Code (CPC). State sellers, such as regional administrations, the Privatization Agency, the Bulgarian Development Bank, state hospitals and companies, auction their own property under their own rules, set out in the notice.

What are the starting price and the bid increment?

The starting price is the lowest price bidding starts from. In an enforcement sale, bids are made in writing in a sealed envelope, and once they are opened, the bidders present may continue orally (Art. 492 CPC). In state auctions the bid increment is in the notice, and we show it when it is stated.

Is a deposit required?

Yes. In an enforcement sale the deposit is 10% of the starting price, paid into the enforcement agent's account (Art. 489(1) CPC). In state auctions the amount and the account are in the notice.

How do I take part?

Read the notice and its documents. In an enforcement sale, the bid is filed at the district court within the sale period, together with proof of the deposit. In an electronic auction, registration and documents go through the seller's platform before the document deadline.

When does the buyer become the owner?

In an enforcement sale the buyer pays the price offered within one week of the sale (Art. 492(3) CPC) and acquires the property when the award order takes effect (Art. 496 CPC). If people still live in the property, taking possession is a separate procedure. In state auctions ownership passes by a contract, as set out in the notice.

What taxes and fees does the buyer pay?

The local tax on acquiring property, set by each municipality, and the fee for entry in the Property Register. Enforcement sales also carry fees under the tariff of the Private Enforcement Agents Act. When the seller quotes a price excluding VAT, we show that too; whether VAT is due depends on the property.

How long is a listing shown?

We show the auction date if the seller has set one; if not, the document deadline; and if there is none, the date the procedure is valid until. After that date the listing comes down.

Can I buy the property through Realistimo?

No. Realistimo republishes the notice and links to the original. The terms, the documents and the bidding are with the seller. Where the original differs from our listing, the original applies.
